A. Double allocation means that two people have been allocated the same piece of Land.

Q. When I purchased my plot in Tegeta, I noticed that the title deed I received is valid for 33 years? What will happen after this time expires. Can the government reclaim the land even if I build a house on the property? - Kevin, Oyster Bay.

A. After that time is up, you are entitled to be offered a renewal of the right of occupancy before any other person. Of course the terms and conditions may be different. Therefore, only when these new conditions are agreed upon can the renewal take place. Otherwise another person can be offered that same land.

Q. Is it against the law to turn a residential house into a business premises (ie. Restaurant; Bar)? – Jeff, Mbezi Beach

A. Yes. When a person wants to change the use of his land different from what is stipulated in the right of occupancy, that person must first apply to the commissioner of Lands before he can undertake new developments.

Q. If you purchase a flat/condo (community home) do you get a title deed?

A. Yes you do. A title deed is evidence of one’s ownership of land or right to property. Purchasing land means the right of ownership is transferred from seller to buyer.

Q. Is it true that as a Tanzanian citizen (mainland) I can not legally own land in Zanzibar? And a Zanzibarian can not own land in the mainland? - Leah, DSM

A. No it is not true; any citizen of the URT can legally own land be it in the mainland or Zanzibar. It is provided by the Land Act, 1999 that any citizen can acquire a right to occupy land.

Q. If you have a plot which you haven’t developed after some time, can the government revoke the land (resale the plot). - Jackie, Arusha

A. Yes, undeveloped or abandoned land may be subject to revocation. The common ground for this is due to failure of the occupier to develop the land in accordance with the conditions of the certificate of occupancy. Land abandoned for not less than two years can be revoked.
